Pink or Blue® makes no representation, express
or implied, that the result of the DNA analysis is fit for
any purpose, other than for personal life-style information
for the client. All materials and products provided by Pink
or Blue® are strictly for informational purposes
only. Clients should consult with their physician(s) regarding
any health or medical needs. Pink or Blue®
does not provide any legal advice, medical recommendations,
diagnoses, and/or treatment of any disease or disorder.
Pink or Blue® reserves the right to refuse
or discontinue services to anyone that may be using our product
for gender selection purposes. If a client indicates that
the Pink or Blue® test is being used for the
purpose of gender selection, we will halt further processing
of the sample and sever any contact with the customer. No
refund will be provided.
Privacy and Disclaimer
The makers of Pink or Blue® respect every
client's privacy. Our company does not share, sell, or distribute
your information to third parties. Your personal information
is used solely for ordering our services, and anything that
is relevant to your order which may require information such
as email, phone number, or address.
When you visit the website, we may automatically collect
IP addresses and site usage information from you. This information
helps us evaluate how our visitors and customers use and navigate
our site, including the number and frequency of visitors and
subscribers to each Website page, and the length of their
visits. Such information does not include personally identifiable
information, such as your name or address; this site traffic
information is not shared with third parties.
Online transactions are handled through scripting designed
for order submittal with Secure Sockets Layer (SSL) encryption.
Your personal information, including your credit card number,

will be deemed non-confidential and are not protected under
our privacy rights. Such unsolicited disclosures shall become
the exclusive property of Pink or Blue® and
Pink or Blue® shall obtain the rights to such
information or ideas for any purpose whatsoever, including
but not limited to, developing, manufacturing and marketing
products.
Pink or Blue® does not guarantee to the client
that the services provided by Pink or Blue®
will meet the expectations of the client or that the products
will be free from defects or free from errors. Furthermore,
in no event shall Pink or Blue® or the client
be liable to the other for any indirect, incidental, special,
punitive, or consequential damages.
1. Provision of Services
1.2 Pink or Blue® makes no
representation, express or implied, that the result of the
DNA analysis is fit for any purpose other than for personal
life-style information.
1.3 The DNA analysis provided by Pink or
Blue® is prepared solely for the use of the
client by whom the product was purchased and/or to whom the
results are disclosed. A client is an individual who has made
a purchase of a service/product provided directly or indirectly
by Pink or Blue®.
1.4 All materials and products provided
by Pink or Blue® are strictly for informational
purposes only. Clients should consult with their physician(s)
regarding any health or medical needs. Pink or Blue®
does not provide any legal advice, medical recommendations,
diagnoses, and/or treatment of any disease or disorder.
1.5 Pink or Blue® reserves
the right to refuse or discontinue services to anyone that
may be using our product for gender selection purposes. If
a client indicates that the Pink or Blue® test
is being used for the purpose of gender selection, we will
halt further processing of the sample and sever any contact
with the customer. No refund will be provided.
1.6 In order to maintain the quality and
accuracy of the services provided by Pink or Blue®,
the test instructions must be followed precisely. Consequences
of the Client's failure to follow Pink or Blue®
instructions, whether intentional or accidental, are the responsibility
of the Client, not Pink or Blue®.
1.7 The biological samples supplied to Pink
or Blue® by the client may be unrecoverable
due to the laboratory procedures required to extract DNA.
Left over samples may be used for quality control purposes
and testing. At the time of ordering, the customer has the
option to request that left over sample not be used for quality
control testing. In this case, any remaining sample will be
destroyed according to state and local regulations.
1.8 Pink or Blue® shall not
be held liable for any damages caused as a result of the use
of the information or products purchased.
1.9 Pink or Blue® is not
liable for any action that might be taken by users of the
services purchased. By purchasing Pink or Blue products, you
agree to release, indemnify, and hold harmless all of its
officers and employees form all liability for the use of the
product(s) purchased.
2. The Client's Warranties and Indemnity
2.1 The client affirms that they are not
using Pink or Blue® for gender selection purposes.
2.2 The client warrants that he/she is legally
entitled to collect the biological samples and supply them
to Pink or Blue® for analysis. Regulations
in your state or country may remove this right; Pink or Blue®
does not enforce state or country specific regulations.
2.3 The client warrants that he/she is legally
entitled to possess the biological samples provided to Pink
or Blue®.
2.4 The client will indemnify Pink or Blue®
and keep Pink or Blue® fully indemnified against
all costs, claims, demands, expenses and liabilities arising
from a breach of the warranties in the previous statements.
